Our platform may record and transcribe phone calls. You are solely responsible for ensuring your use of call recording complies with all applicable laws in your jurisdiction and the jurisdictions of your callers.
Many jurisdictions require that all parties to a phone call be informed of and consent to recording (e.g., California two-party consent law). You must configure appropriate call disclosures and obtain necessary consents before recording any calls through our platform.
DirectCall.ai shall not be liable for any legal claims arising from your failure to comply with call recording laws.
Our Property: All software, algorithms, AI models, interfaces, designs, and content that make up the DirectCall.ai platform are owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our services during your subscription.
Your Data: You retain ownership of your business data, call recordings, and customer information. By using our services, you grant us a limited license to process this data solely to provide and improve our services.
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of data as described in our Privacy Policy.
Our platform may integrate with third-party services (e.g., Google Calendar, Calendly, CRM systems). Your use of such integrations is subject to the terms and privacy policies of those third parties. We are not responsible for the availability, accuracy, or practices of third-party services.
We strive to maintain high availability of our platform but do not guarantee 100% uptime. We may perform scheduled maintenance with reasonable advance notice. We are not liable for service interruptions caused by factors outside our reasonable control, including internet outages, third-party service failures, or force majeure events.
Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our AI will be error-free, that calls will always be handled perfectly, or that the service will meet all your specific requirements.
To the maximum extent permitted by applicable law, DirectCall.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or loss of business opportunities, arising from your use of our services.
Our total cumulative liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid us in the three (3) months preceding the claim.
You agree to indemnify, defend, and hold harmless DirectCall.ai and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.
We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. Upon termination:
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in Chicago, Illinois, except that either party may seek injunctive relief in court for intellectual property violations.
We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email or through our platform at least 14 days before the changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.
